Section 2 of the Wills Variation Act states that “despite any law or statute to the contrary, if a testator dies leaving a Will that does not, in the court’s opinion, make adequate provision for the proper maintenance and support of the testator’s Spouse or children, the court may in its discretion, in an action by or on behalf of the Spouse or children, order that the provision that it thinks adequate, just and equitable in the circumstances be made out of the testator’s estate for the Spouse or children”. In this statute, “Spouse” also means common-law Spouse where the parties have co-habitated for at least two years. If you are choosing to leave an unequal distribution or to leave a Spouse or child out of your Will altogether, we will ask you to provide a memorandum setting out in as much detail as possible the reason.
